Legal Question in Bankruptcy in Texas

Filing Bankruptcy on a Home that is Co-owned

I purchased a new mobile home in 2000 and my aunt is a co-buyer on the home. She does not live in the home. She was a co-buyer for credit purposes only. Can I file bankruptcy on the home since she is also a co-buyer? If so, how will this affect her credit?

Re: Filing Bankruptcy on a Home that is Co-owned

I think I understand your question. If you file bankruptcy and attempt to eliminate this debt you can do so. This means you will surrender (give back) the mobile home. If this is what you mean then I think it will effect your aunt because the creditor will be able to go after her.

The other option is to file bankruptcy and keep the mobile home. Even if you are a few months behind a good attorney can keep you in your home without having to give it back. Please feel free to call me to discuss your situation so that I understand exactly what you have in mind. ph. (972) 231-5500 or (800) 303-0720
