Legal Question in Bankruptcy in Texas
Filing A Motion To Sell A Home That's Not In Bankruptcy
If you filed bankruptcy due to arrears of one home and you had a second home that was paid outside of the bankruptcy plan, and now you want to sell the second home(because your house note jumped up $400.00 due to shortage of estimated escrow, and you know that would completely throw your budget), is it necessary to file a motion w/ the courts getting permission to sell this home if it was being paid outside of the plan?

You must notify the Trustee, who has equitable title to ALL your assets (I am assuming house #2 was listed as an asset in your schedules).
