Legal Question in Bankruptcy in Texas
house in other state in my name
I read that only one spouse has to file bankruptcy. I have a house in my name in another state. If my husband files bankruptcy, can my property be taken since this is a community state?

The answer is somewhat comples, for example, when did youaquire the out of state house, how did you aquire it and did youuse community funds to pay the mortgage, if any.
The other thing that comes to mind is the fact that if only one spousefile, the creditors can still come after the other spouce. So, while I have filed single spouse cases before, it is not simple.
