Does my husband's ex-spouse have the right to sue us after bankruptcy?
My husband ended up with $25,000 in credit card debt from a previous marriage. This was half of what she ran up & he got stuck with in their divorce. This past year we had to file bankruptcy because we saw no way out & couldn't afford to pay her credit cards. Now we are finding out that papers will be served tonight for my husband from his ex-spouse & we're assuming that she is suing us for that amount of money. Since our bankruptcy has been discharged can she legally make us pay her, or even worse, can she put a judgement on our property or retirement, etc?

It depends on if she was listed as a creditor in the bankruptcy. If she was then she probably has no right to sue for the credit card debts. I would have to know what the lawsuit is about before I could really answer your question. Please feel free to call me at (214) 637-0713
