Legal Question in Bankruptcy in Texas
Insurance Coverage
My husband is self employed and cannot get independent insurance because of a medicial condition. I currently have insurance through my employer, but need to stop working due because of my daughter's medical issues. If we file bankruptcy, will the law allow us to include COBRA payments (approx $1,000/mo) for insurance, for the medical care and meds for my daughter and husband?

Re: Insurance Coverage
I think I understand your question. If at the time you file your bankruptcy case you can show receipts for the COBRA payments then (in my estimation) these are valid expenses. Your monthly expense budget will be examined by the Trustee assigned to your case and perhaps by others. However, in my experience most Trustees do not challenge expenses related insurance and healthcare.
