Is means test for chapter 7 bankruptcy evalulated befroe are after taxes?

I think I understand your question. The gross income (before tax withholding) for each spouse is used to calculate the means test. However, if you are over the means test number based on your family size this does not automatically mean you cannot file Chapter 7. I would not advise you to file without an attorney. Line 3 of the Form B22A asks for pre-tax numbers. Line 25 of Form B22A asks about the taxes. Of course there are lots of other numbers that go on the form, and many of those numbers are subjective.
