Legal Question in Bankruptcy in Texas

cant pay bills

Dear sir i am a 62 year old male disabled in 1996 and i cant pay my bills with my disability pay, i have a wife and 14 year old son both with no insurance . i would like to know if i should attempt to file for bankrupcy or what will happen if i pay only the bills that i can pay ,iknow it will ruin my credit but i can't keep on this way . if i dont pay all my bill and just pay what i can i will be able to pay for my medicen which is about 300 a month. but i need some advice about i can't afford a lawyer . thank you george arthur. if i dont pay all my credid cards will anything happen to me except ruin my credit. thanks

Short answer -- you certainly can be successful in a Ch. 7 case.

I STRONGLY RECOMMEND YOU FILE. Emotionally you would benefit from filing bankruptcy because you would no longer have to worry so much about these bills. You deserve a fresh start. All of you medical bills would be "discharged" (bankruptcy term which means eliminate or wipe-out). Your home and your car and all over your other personal property would be exempt from creditors. This means you would keep all of your property. The fact that you receive some income each month will also not prevent you from filing Ch. 7. Many people, unfortunately have the mistaken belief that they must be near poverty to be eligible for filing a Ch. 7. This is not the case. Sorry about your troubles. I suspect most of your assets are exempt from creditors, except the tax man. Therefore if you quit paying the creditors will be unable to get nothing, but they may keep calling you trying to get something. If you file bankruptcy the creditors will quit calling. While you may feel you can't afford bankruptcy, remember that the creditors you are now paying every month will no longer be paid so you will have lower payments each month. Call to discuss.
