Legal Question in Bankruptcy in Texas
Personal Bankruptcy 2001
I did not include my home in the bankruptcy, because I thought I had to continue making payments. Is this true or would the home essentially belong to me?
Now the home has been sold in 2001 at what was owed on it. Did I miss an opportunity to keep this home?

Re: Personal Bankruptcy 2001
If you had a home loan, it is likely that loan was secured by your home. In a secured loan if you fall behind the lender can forclose and take your property which apparantly is what happened to you. Had you listed the home loan in a bankruptcy you would have had to continue making payments or lose the home. The most that you could have done is that you might have discharged liabilty to pay payments that you were behind on at the time you filed. Short answer, probably not.
