Legal Question in Bankruptcy in Texas

My son had a 2003 Grand Am repossessed by a bank as he lost his job. The bank is now (2009) trying to get him to pay. He's to go to court now about this 6 year old account. He was recently laid off his job. What can the bank do if he has no money/income? Would filing bankruptcy help?

He has two options, fight them in court or file for bankruptcy protection. If he fights them, he would have an affirmative defense. If he files form bankruptcy, then the bank cannot do anything.
