Legal Question in Bankruptcy in Texas
Selling house, have filed Ch 13
We are trying to sell our house. We are currently in Chapter 13 but the mortgage is not included in the bankruptcy. The Title company for the closing wants something from the court but we are having a hard time getting this. Should we pay off the bankruptcy or continue to try and get the information requested. Should there be a problem to sell our house?

To sell real property during the pendency of a Ch. 13, you must file with the court a Motion to Sell and attach a copy of the earnest money contract. The court will sign an Order approving the sale --this is what the title company needs. This process usually takes between 10-20 days.

Whatever you do, the title ocmpany will require something from the court. You need to involve a bankruptcy attorney to get things moving.
