Legal Question in Bankruptcy in Texas

Can just one spouse file for bankruptcy?

Married couple : Lost job and I had to take a cut in pay over a year ago. Question: Can just ONE spouse file for bankruptcy ? The credit cards are mainly the items that I am wanting to list. Some of the cards are listed under just one name, myself, others are listed under husband's also.

The cards that my husband has he will be able to pay over time, this the reason why I am wanting only the large ones to be listed in the bankruptcy.

1-spouse bankruptcy

Unless you have been sued and are about to have property taken by attachment, foreclosure, repossession or garnishment, do not file bankruptcy. If you can't make all the credirt card payments, parcel out what you have available and allocate it among the credit card companies.

Many bankruptcy judges will not graqnt a discharge of credit card debt if the card has been used within twelve months of the date of the bankruptcy filing.
