Legal Question in Bankruptcy in Texas
How to stop a scamster from filing bankruptcy
Assuming you win a fraud judgment against a defendant in civil court, what do you have to do stop him from filing bankruptcy. More specifically, how do you know WHEN and WHERE he files bankruptcy so that you can show up to the proceedings and stop the debt from being discharged?

When bakruptcy is filed, all creditors are sent notice of a 341 hearing, and your are sent info on how to file your claim. You can also file an objection to discharge of your debt. Many fraud claims cannot be discharged in bankruptcy.
