Texas Bankruptcy Residency Requirements

How long must one live in Texas before being able to file for personal bankruptcy?

The Bankruptcy Code states that an individual must file where he or she resided for at least 180 days prior to filing or where substantial property of the person filing is located. However, the issue of where to file and how long you must wait to file rarely becomes an issue. My personal opinion is that if a person did not want to wait for 180 days to file in Texas, the Texas bankruptcy system (Judge's and trustees) would not be overly concerned about this and the fact you filed before 180 days would not be challenged. At this time, you can file bankruptcy in the district where you have resided for a majority of the 180 days before you file.
