Legal Question in Bankruptcy in Texas
Do I have to write-off my patient's debt when they file bankruptcy?
I am the manager of a Diagnostic Imaging facility. I receive bankruptcy notices(chapter 7 and chapter 13)on many of our patients. I am not sure what to do with the patients debt. Do I write-off as a bad debt? If the patient wants to be seen at our facility in the future, may I ask for payment upfront or refuse to see the patient?
Any help would be greatly appreciated. --

Re: Do I have to write-off my patient's debt when they file bankruptcy?
I would suggest that the best course of action would be to require up front payment. In many of these cases the patient will have been discharged from the debt owed to you, so you should not ask for payments on prior debt. However, if the patient's bankruptcy was dismissed without discharge the debt would still be owed. Larry Maun 713.266.2560
