Legal Question in Business Law in Texas

So 3 months ago I bought a car from a friend that runs a mechanic shop. The car was not in a running condition. The agreement was that $2800 would cover the price of the car and all the repairs that needed to be done to get it in a good working condition, and that the timeframe for it to be completed would be 3-4 weeks. I paid the full price of the $2800 at that time. Now, 3 months later, none of the work has been done on the car (transmission, water and fuel pumps, spark plugs, distributer, and gas tank) and I have not received the title. I have been in communication with my mechanic the whole time. He just keeps telling me he is working on it. I am moving out of state in a week, and I need either my car to be fixed and running, or my money back. When I spoke with my mechanic today, he said he could get my car running, but it would cost me at least another $1000, or he could give me a different car and split the cost of it's repairs (transmission) with me. I told him I would just like to ask for a refund and his response was that I could just come pick it up then. He then mentioned that he could possibly get my car running and then sell it to get me my money back, but when I asked about a time frame he said whenever he had free time he might be able to work on it a little and that it would take a long time. I really just need my money back, this guy hasn't held up his part of the agreement so far and I have no reason to believe that he will do otherwise if I agree to one of his options. I'm still not exactly sure why it is him giving me options and not the other way around when it was not me that failed to uphold our agreement. My question is what do I need to do, and what can I do, to resolve the issue and get my money back.

Unless he is willing to give you the car or your money in a satisfactory manner you will have to file suit to recover your money.
