Legal Question in Business Law in Texas
3 months ago, a guy I work with asked if I wanted to help him start a barbershop.
I wrote a $12k check to the guy along w/his $10k. No official paperwork has ever actually been filed to create the business, and the only paperwork we have on this is an agreement saying I was contributing $12,000 to set up a barber shop.
Within weeks, a third guy bailed and got his money back from the deal.
Found out that we had backed out of the lease on the building that was to be the barber shop and lost a $1k deposit. He gave $10k of our money to a strip club in return for 2% of its monthly profits (verbal). Was okay with it, but have seen nothing except $300 for September.
Just learned this guy has been fired, has a DUI, weapon, and drug charges and I don't trust him. Can I recover my $12k?

In Texas, one can form a partnership without anything being in writing. You and this guy have a partnership.
You would file suit to dissolve the partnership. You'll want to get a good lawyer to help you with this.
