Legal Question in Business Law in Texas
Bank Account ownership (Texas)
We have a small business (LLC) with 2 owners, but only my partner was the account signer at the bank. Now he's left the partnership and lives outside US. He has been trying to help but the bank does not seem to do this over the phone. He has given me power of attorney but the bank apparently does not accept power of attorney for business accounts either. What can I do to prove the ownership of the company and get the control of the bank account?
1 Answer from Attorneys
As a Franchise Attorney I think the easiest solution is to talk to the bank, explain the situation and ask them what needs to be done. In the future, always have more than one signer at the bank. You never know what can happen. Consult with a good business or franchise attorney in your area for specific advice.
