Legal Question in Business Law in Texas
bank check
By mistake i sent my mortgage payment in an envelope addressed to my credit card company. They cashed the check and it wasn't even made out to them. Is this legal? My credit card pmt. Was mistakenly sent to my mortgage company and they sent the check back and i in turn wrote out a proper check to them. Shouldn't the credit card company have sent the check back so i could correct the problem.

Re: bank check
Yes, they should have, but they don't. The checks are processed without reading them. You can complain to your bank because they paid on the check with improper endorsement. They'll refund the money they paid and then bill back the credit card company. You'll have fun unscrewing the mess because now the credit card company will have to adjust their books.
