Bonus not paid after leaving employment

While with my last employer I earned a bonus for selling services. The bonus is calculated by quarter and paid out the following quarter. I resigned a few days before the bonus would have been paid and the company and so the company is saying that I am not entitled to it.

Firstly, this seems to be an onerous requirment since I ddi the work and the revenue was earned by my company.

Secondly, this was not mentioned in the documentation that I received.

Thirdly, some of contracts were lost by my company and had to be resigned delaying the processing for over six months and hence the payment by the same amount.

Unless there's something in writing, which you should have been aware of, stating that earned commissions are only paid if you are employed on the date of payment, you probably have a shot at recovery. The question is whether the sum is greater than $5,000.00 or not.

If less than $5,000.00, you can proceed in Small Claims without a lawyer.
