Legal Question in Business Law in Texas
Breech of a verbal contract and harrasment
My name is Sabino Duran, and I have been with Casa Manana restaraunt for over 40 years. The original owner passed away about4 years ago, but prior to passing away he made a verbal contract to me stating that I would be made part owner and that he was going to do the paper work. The paper work never was started. More than one person heard this , and he also mentioned it to a number of friends and family. His wife was left the business and her son runs it for her.I have asked him and her numerous times about ownership, but was told that they know what was said, but can not do anything about it since nothing was completed in writing. Now the son of the original owner has his son and daughter in law there harassing me on a daily bases. I want to know where I stand on a ownership breech of verbal contract and or harassment law suit. I have never sued or spoken to a lawyer before, but I feel violated for giving more than half of my life to this place and have been stripped of all authority there. Please help me regain what is owed to me.
P.S. please include some of the laws they may help me further you could.
Thanks ,
Sabino--name removed--

Re: Breech of a verbal contract and harrasment
I am sorry to have to tell you that without something in writing from the now deceased owner, you do not have anything legally enforceable. A dead man's verbal gifts do not count.
That others know of the intent, and do nothing about it may be morally reprehensible, but it's not legally actionable.
