My business failed and I had to break my commerical lease. Can the landlord take my house?

As a Franchise Attorney I can say the following. Without reviewing the terms of the lease you signed, it's not possible to say. Usually, the remedy of the landlord is to sue for rent owing. He or she also has a duty to use best efforts to rent the space to someone else. Once they go to court and get a judgment against you, they need to execute the judgment, going after any assets you have. Consult with a good business or franchise attorney in your area for specific advice.
