Legal Question in Business Law in Texas

I have been married for 11 yrs. as of Feb28,2009. On Dec. 28,1998, I went and got a DBA in my own name only ( Individual) ownership, and started a small const. co. It is a construction co. My husband does the jobs, and I run the office, etc. I've even helped on quite a few jobs in the field to. For the last 7 yrs., my husband has been getting the checks from our customers, and taking them to our bank and getting them cashed, or getting an immediate approval on the checks and depositing the money into his personal acct. that I have no access to. I do have a business acct. that is solely in my name, and I did have my husband put on that acct. as a signer only. My husband does not give me any money off of the jobs that are being done by my co. When and if he does, it is very, very little. My business acct. stays in the red, because he overdraws it, and want put any money back in. He has also done jobs under my co. and had the client write out a check directly to himself, and not the co. I want to get a divorce, but hasn't my husband been embelzeling money from my co. or commiting fraud. He actually works for me. Please help, I'm very desperate.

This is quite a mess. Do you have anything to show that your husband is an employee?
