Can your business partner open a business with a similar name and start taking you business through his new company?

All depends on what your partnership agreement says owners can and cannot do. If no partnership agreement exists then you rely on the default state law which may give you remedies depending on the specific facts. I would suggest consulting a business lawyer for a consultation.
