car jam

my wife dropped her car off at a car wash, and a worker ran another vehicle into it. the car is totaled and when we tried to collect the businesses insurance company, the manager refused, even after the officer at the scene requested it. we are now one car short and we have no way of having their insurance provide us with atleast a rental car or to take care of any of the damages. our insurance company gave us the option of getting a rental car, but it would be coming out of our own pocket. we turned our claim into our insurance company, and even if the car is totaled, we would still have a $500 deductible coming out of our pocket. we had nothing to do with this disaster and we are the one suffering instead of the company that did the damages. do you have any suggestions that we can take?

Your insurance company can file a subrogation suit against them and reimburse you, but that will take a long time. Otherwise you will have to sue them for this property damage which is not a lucrative position either.
