Legal Question in Business Law in Texas
Is charging employees for money shortages legal when the company comes up over a
I work at Sonic Drive-in. Just this last month the store has changed its policy on shortages made by carhops. Every day we are given a bank and at the end of the day we turn it in to be counted. The computer records what orders we take out and the amount we should have in our bank. The new policy says that we have to pay any shortages that we make at the end of the day, before we leave. Yesterday almost half of the carhops were short and paid, but the books say that the buisness came up $200 over for the day. Is this legal?

If your tips are considered wages, then under Texas law, unless you consented in writing, then your employer may not deduct ANY amount from your pay. Complain to a local attorney or directly to the Texas Workforce Commission. They can assist you in getting your money back.
