Legal Question in Business Law in Texas

i got the old ''check is in the mail'' routine

long story, but Ill try to make it short--Chase America Warranty Co. owes me a refund check from an extended warranty plan I purchased on a used car. the car was traded in to a dealership and the dealership told me that if I did not use the warranty, which I did not, that I could get a reimbursement of what was paid for the contract. However nowhere in the paperwork I got from them does it state that they issue such reimbursements, but when i called to check into it they started the paperwork on the refund. this was April. After their 5-wk. waiting

period, the check was supposedly sent but I did not receive it, i notified them and another check was issued after another 2-wk. wait. This was June and still no check.I have called once a week, spoke with the accounting dept., the supervisor who won't return my calls, and finally have wrote a letter to their upper management at the suggestion of their accounting dept. but that was weeks ago and still no reply. I don't know what to do next.

Small Claims court is one option. Having a lawyer pursue the issue is another.
