Legal Question in Business Law in Texas
Collect judgement in texas
I have won a judgement against the defendant in California, now she moved back to Harris, Texas, I got a writ of execution from CA to be executed in Texas, I call Harris County small claims, and they said there's no such form, in CA Small claims court told me to ask for a sister state judgement form, and Harris said no such form? I just want to collect my judgement, she wrote bad checks. So how do I go about to collect this judgement from CA?

Re: Collect judgement in texas
You need a conformed copy of the CA judgment from the CA court clerk, so you can file it as a sister-state judgment in Texas. That's sometimes referred to as a three-part affidavit with certified copy of the judgment attached.
That then gets filed in Harris County and after a period of time (depending upon the court in which it's been filed) the judgment is treated as a final Texas judgment that you can now attempt to collect.
Texas is a debtor's haven, and collection against an individual is very difficult. You will probably need a local attorney to assist you. We do not handle consumer debt or collection against individuals unless they own and operate a going business, because you can't garnishee wages, seize and sell motor vehicles, etc.
