Can I use a name for my company if it is the same as someone elses company name? There company is in Atl. Ga. Mine will be in Hou. Tx. They are a small business.

It would depend on a number of factors such as whether the Atlanta company has a registered trademark, whether your business is similar to the business of the other company (which would lead to confusion) and other factors. You should contact an attorney experienced in trademark law for a risk analysis.
