Use of my DBA name by other on their web page

Have registered DBA with Dallas and Collin County, operating an apartment locating service in both cities now another locator doing the same business in the same cities has used our name name on their web site-and purchased the domaine name with same, after we registered our DBA, and will not cease use of the name or relinquish the domaine name, do we have any recourse? Is there a way to make them stop using our name and cancel the .com address?

If you have a tradename established, a court can issue an order to the other business to stop using your name and deregister the name to allow you to take it. I have done this once before for another client.
