Legal Question in Business Law in Texas

I decided to try one of those home business things, they took my first payment from my bank account on 5/26/10. There is a 30 day trial period in which you can send back the kit and get a refund. My husband got upset with me for doing this,so I called the day before they were going to take my payment, and tried to cancel, they said there was nothing they could do untill I sent the starter kit back (which they were not sending untill they got my first payment). I have still not gotten my kit,and I feel like that since I am trying to cancel, they are trying to make sure I am past my 30 days. Is there anything I can do,or do I have any rights?

Any attorney will tell you more facts are needed. How did you pay? When does the 30-day trial period start - when you get the kit or when you make the first payment? Consult with an attorney in your area for specific advice.
