My husband is an offshore welder and just found out that he is now considered an ''inactive'' employee. The only reason why we knew something was wrong was when we tried to fill a prescription and was told that our insurance was cancelled. Because of the nature of his job, he works for weeks at a time and is off for days to weeks at a time also. He came home from a job the first week of may and had been in contact with the office since then waiting and checking on which job he was to go on next. His employer just told him that there were not any new jobs and that they would call him. We now found out that he was terminated on may 12th. We understand that this is a hire/fire at will company, but he was never notified & was still led to believe he was actively employed. They basically put him off saying that there was no work instead of telling him that the company loss several contracts and needed to downsize. Is it unlawful for an employer to NOT tell you you are terminated and make you believe you are still employed?

He may have a claim if it's a Reduction in Force (legal term for downsizing). Maybe an expert in that area will chime in here. Otherwise, see an Employment Law attorney. Maybe your husband was not the only one affected. Good Luck.
