Legal Question in Business Law in Texas

Definition of a store front?

A driver ran thru the front of my store and thru the wall. The driver doesn't have insurance. The insurance is only paying to replace the windows. The landlord is refusing to pay the damage because they are claiming the front wall is part of the store front. I am telling the landlord the wall is part of the structure and they should be paying for it. Which one of us is correct? My interpretation of store front are the door, windows, not the wall. Thanks for your help.

Your contracts with the landlord and the insurance company will need to be reviewed, but obviously the wall is part of the premises and the landlord is generally responsible for major repairs to the premises. You should get a lawyer on this because the insurance company has its lawyers helping them and the landlrod.

Get a lawyer to help you go over the lease and help make the determination as to who is responsible for what. The sooner the better, since there are two insurance companies with their lawyers that you are actually dealing with.
