Legal Question in Business Law in Texas

disaffirming a contract made while under age of majority

I purchased a laptop when I was 15 from Dell computers, i paid $3,740.00 for it. It has fallen apart, and I have realized that I made a bad decision to buy this. I am now 19 years old. I have learned about the law regarding disaffirming a contract. How do I go about getting my money back, and do I have a chance?

For a minor to disaffirm a contract, he must do so within a reasonable time after he becomes an adult. I suspect that most courts would hold as a matter of law that waiting a whole year went beyond a reasonable period of time. Therefore, the question of whether your claim is or is not meritorious is moot. However, I will comment that most computers effectively have only junk value after four years of use.

You would have had to taken steps to disaffirm the contract within a reasonable time after you reached majority. I seriously doubt that a court would find a one-year wait to be reasonable, particularly after you got four years of use out of the laptop.

I don't think you have much of a chance.
