Legal Question in Business Law in Texas

False Advertisment

I went to a Pizza Hut where they have ''carry out in 20 min or its free, We promise'' I ordered two pizzas over the phone at 2:58 recipt time and i went into the store at 315 pm but didnt recieve my pizza until 330pm. I went outside and read the banner of the 20 min promise and told the MGR on duty and he said, with a smirk infront of his empolyees that they do not do that. Since it is posted on a banner and i didnt recieve my pizza in 20 min and the pizza was not free, could this be False advertisment.

Re: False Advertisment

It could be. However, the interpretation is open to question. If you got there at 3:15 and received your pizza at 3:30, arguably that's only 15 minutes wait. You say you placed your order at 2:58, but don't say what their records might show if you force a lawsuit.

It might be an amusement to bring suit, although you might be surprised at how difficult it may be to prove your case.
