Legal Question in Business Law in Texas

Giving Legal Advice

I have been approaced to provide human resource related advice via message board for a company based in Texas. I would moderate the board and answer questions asked by this company's clients. I am not a lawyer, but someone who is qualified to this type of advice. Although I would not be giving legal advice per se, in essence HR advice almost always includes some type of legal element. Do I need a license for this? What kind of liability am I facing? Should I take out additional insurance to cover this liability?

Re: Giving Legal Advice

I am not familiar with any licensing requirements in Texas for giving advice regarding HR matters. There are restrictions on practicing law without a license. The State Bar of Texas has an Unauthorized Practice of Law Committee which could advise you on guidelines used to determine whether you are crossing the line to practicing law. You should be able to contact the Committee through the Texas Bar Association web site. Larry Maun 713.266.2560
