Legal Question in Business Law in Texas
Giving Legal Advice
I have been approaced to provide human resource related advice via message board for a company based in Texas. I would moderate the board and answer questions asked by this company's clients. I am not a lawyer, but someone who is qualified to this type of advice. Although I would not be giving legal advice per se, in essence HR advice almost always includes some type of legal element. Do I need a license for this? What kind of liability am I facing? Should I take out additional insurance to cover this liability?

I am not familiar with any licensing requirements in Texas for giving advice regarding HR matters. There are restrictions on practicing law without a license. The State Bar of Texas has an Unauthorized Practice of Law Committee which could advise you on guidelines used to determine whether you are crossing the line to practicing law.
