Can a HOA prohibit the operation of a Licensed Childcare Home in Texas?

As a Franchise Attorney I can tell you the following. You need to consult your HOA Bylaws or Rules as they will set forth restrictions on a home-based business. A childcare home would be potentially noisy and accompanied by a lot of traffic. So, it wouldn't should not be a surprise it it's prohibited by the HOA. Consult with a good business or franchise attorney in your area for specific advice.
