Legal Question in Business Law in Texas
The following information was noted in my offer letter:
Signing Incentive: $5,000, subject to tax withholding, payable on your first paycheck and to be reimbursed to the Company in full if you voluntarily terminate you employment prior to completion of 24 months of serve. See enclosed Signing Incentive Repayment Agreement.
Can they hold me to the full $5,000 if they cannot provide the signing incentive repayment agreement and I've given 12 months of service?

Based on what you have written, generally the employer may not need the actual written agreement to prove your acceptance of the 24 month employment agreement and signing incentive.
