Legal Question in Business Law in Texas
Lessor Failed to Disclose
I recently rented a travel trailer from an RV rental business. Orignally, I was only interested in renting a popup as I drive a mid-size SUV. Upon telling me they were all out, the woman suggested I rent a trailer. I imediately told the woman, I had concerns about the weight, etc. She told me it only weighted 2500lbs. In any event, I ended up renting it. While I was there, I asked again twice about the weight. Both times they said around 2500 lbs.
At only 90 miles from home, my transmission overheated and blew. We had to have my vehicle and the trailer towed. Family members came and got us and our belongings, child and dogs.
It turns out that the trailer weighs considerably more than the 2500 I was told. It weighs 3400. Do I have any recourse to seek for damages; trailer rental, towing costs, lost vacation and an enourmously expensive transmission?
Regards, Mark

You have a reasonable shot at an action under the Texas Deceptive Trade Practices Act. Get in touch with a lawyer in your area that handles that sort of consumer law.
