Legal Question in Business Law in Texas

Local Power Broker Bankrupting our Minorty owned business

I am a spray foam contractor in Texas. I had a contract with a custmer. They refused to pay us the original spec contract, and would not pay when we completed it the first time. They upgraded the original specs, and agreed to pay me the diffrence. The General contractor doubled the material installed originally. The job was large and they did not pay when we completed. The contractor checked every inch and gave the job the ok. They owe 30K+ the contractor knew that we are a HUB, and streched on resorces to do the job. Upon completion the contractor and owner refused to pay when the majority owner, a woman, presented the two with an invoice. PART 2: the owner is still refusing to pay a lien that has been filed, and the owner is Now in the process of starting his own spray foam insulation company now that he has bankrupted ours. The contractor was told that non payment would bankrupt us, both parties knew that a minority was the majority owner. What course of legal action can be taken? Discrimination? They knew we were minorty owned, the lien is not working, we have 5 children under the age of 10, and our life savings invested in this business. We worked hard and could have profited 2005 fisical, after 2 neg years, if they had paied.

An action for discrimination won't work. You need legal counsel to enforce the lien and sue for payment or foreclosure. If matters are fiscally desparate enough, you might consider taking the company into bankruptcy, with the lien and claim as an asset of the estate for the trustee to pursue.
