Legal Question in Business Law in Texas

Is there a maximum number of hours a retail salesperson can work per week?

Is there a maximum amount of hours a retail sales manager can work per week? My husband works at least 54 hours per week and does not have the option of lunches or breaks during his 11 hour work day. He is the only one in the store and cannot leave. The corporation also states that he is liable for an NSF check a customer wrote to the company because he received a commission for the sale. He was demoted for leaving 30 minutes early on one of his 11 hour days because of a family emergecy. Is that also lawful since there is never another employee that can cover him in emergency circumstances? HELP!!!??????

Your husband should contact the Texas Workforce Commission. It certainly sounds like an abusive situation.

As to the NSF check, his commission may be forfeit for the bad check, but he should not be held responsible for the entire check.

If your husband's employer has more than 15 employees, then a whole host of federal rules and regulations come into play. Does your husband get time and a half for overtime? Or is he straight commission?
