Non-compete/ Client and Employee

I own a Personal Assistant Service. We are an in home care provided for the elderly. When we hire an employee they sign an agreement that they will not work for our clients on a personal basis for a period of two years after termination of client or while still our client. or they will be terminated and a fine of $5000.00 and court cost, if necessary ,to retain our money. The same for a client, they have also signed agreement that they will not hire an employee or an ex-employee for a period of two years. They are to pay the net amount that our company would lose from this breach of contract or $10,000.00 which is greater. Payment to be made within 10 days of demand.If client or employee refuses to pay what proceedures would be necessary to ensure payment from both parties and is this a legal contract? What court would you file in and do you have a time frame to do so?

Your Agreement probably needs to be reviewed by counsel. However, generally it is enforceable in a court of law but only with a lawsuit brought within 4 years of the breach. Call me at 214-520-0000 if you need more help.
