As a Franchise Attorney I can only say yours is more of a criminal law question than a business one. In embezzlement cases, full restitution is sometimes offered as an incentive to drop criminal charges - which is a strong motivator. I've also heard of being offered in lieu of criminal charges. Consult with a good business or franchise attorney in your area for specific advice.
