Overtime Pay

A person we employ makes $20.00/hr. (obviously twice the minimum wage.) This person continuously bilks the company for overtime, i.e., working 20+ hours of OT (40 hour work week), that is not approved by management. Can you please tell me if the company is obligated to pay his overtime at ''time-and-a-half'', or is ''straight-time'' pay legal for this OT?

If this person is paid hourly, and works more than 8 hours per day and more than 40 hours per week, they are entitled to overtime pay at 1-1/2 times their usual rate. They can be sent home by their supervisor at the end of their shift, and forbidden to work more than 8 hours or 40 hours a week, to cut off the abuse. Just make sure it's documented.
