Legal Question in Business Law in Texas

Who owns the picture?

I have a small hobby that earns a little money: bronzing keepsakes, like baby shoes, ballet shoes, etc. I take a picture, with my camera, of the item to be bronzed before the bronzing and after the bronzing; this is a way for me to keep a good record of what the product looked like before and after the service of provided. Who owns the pictures? Can I put the picture I take of the product after it has been bronzed and put it on a website? Does the customer have any right to the picture? Must I ask persmission to put the picture on a website?

Thanks.

Who owns the pictures? You do.

Can I put the picture I take of the product after it has been bronzed and put it on a website? Yes. If the item is unique, I suggest you apply for a copyright for the picture itself.

Does the customer have any right to the picture? No.

Must I ask persmission to put the picture on a website? No. The picture is yours to do with as you please.

Re: Who owns the picture?

I cannot agree with Mr. Bradie. My image is mine and cannot be published without my permission. If you want to publish a bronzing that you are proud of, I suggest that you obtain a release for limited purposes of displaying your work and not for commercial purposes for the image. That can be inserted into the contract or receipt for your services.
