Legal Question in Business Law in Texas
Partners closed business w/o consent & stole records, monies!
Husband joined into general partnership and opened drafting business. Then the others suddenly told him to leave and gave withdrawl to sign. He said he would as soon as he got all of the records, bank statements, tax info. that he needed and was outlined in the Partnership agreement. They have told him no. So he never signed the withdrawl. In Jan he recieved an unsigned note on company letterhead stating that they closed & heard that they opened the business with LLC this time. But there is high possibilty that they are taking the old company revenues(that were outlined in the agreement to be audited,used for debt and distributed to partners) and putting it into the new company. So he sent certified letters demanding the info or he will take legal action. He would have let them go had they just given him what he needed to do his taxes.These ''partners'' had ME open postal box for them. I am not part of the partnership. My signature is on the box.I added them as allowed to recieve and p/u mail there. They havent paid it and now I am in debt plus the keys that I cant get from the partners. The only mail I got was--name removed--check. It is unopened. What should we do?

Ordinarily, I try to give answers that allow for "self-help" so far as reasonable and possible. Your husband's problem has so many ramifications, that the only reasonable suggestion that I can make is to contact an attorney as soon as possible in order to protect your husband's rights as well as to protect him from claims of creditors.

This is far too complex for a do-it-yourself approach. Get to an attorney ASAP.

Your husband should consult an attorney quickly; he will likely be able to sue for an accounting, at least.
