No permit

In the state of texas is it legal to sell cooked food from your own bar be que without a permit. I know someone who is doing this and the bar que pit has been outside exposed to cat germs, such as hairs and feces, and the apartment where they live has no running water in the kitchen, although there is water running in the bathroom.
