Legal Question in Business Law in Texas
Is a person legally allowed to drop off a rental car to a valet service? If not, but they drop it off anyway, does this in any way place liability on the valet company for accepting it? Also, what if the car gets damaged? Would the valet service be absolved of liability since the renter of the car isn't supposed to hand off possession of the rental to them? I own a valet company and we have had people take the key off the hook so we don't know it's a rental. But every time I rent a car, the guy tells me DO NOT let anyone else drive the car. I've even asked if I can valet the car, and I'm always told not to valet the car.

The valet company is always going to be liable for the negligent or intentional acts of the company and its employees. The other relationships just affect who can recover from who. It is not a defense to the acts of the valet service that the renter has breached his or her own agreement with the rental company.
