Legal Question in Business Law in Texas
Photo Release Required?
Have seen several businesses that offer action photos of children in sports activities for sale to relatives. I am interested in providing a similar service but would like to know the risk of photographing people's children and posting the photos on the web for sale. Releases required? Permission required?

Re: Photo Release Required?
Before you can post someone's picture for sale to the general public, you need to get their permission to do so, and a release of privacy claim. Where the picture is of a minor, you'll need the permission and release of their guardian. That's usually a parent.
Once that's done, if the picture is very good, you may consider getting it copyrighted. That prevents others from using your picture without a license from you.
