Legal Question in Business Law in Texas
If we are going to send a final letter requesting payment for services that have been completed (8 months ago we did gutter work) are we allowed to state that we will go after theft of service in the letter?

You shouldn't threaten criminal action in an attempt to collect a debt.
You CAN threaten to file a civil suit. Put it this way: "If this amount is not paid in full by January 4, 2010, we will file suit against you and seek a judgment for the amount of the debt plus attorney's fees and court costs."
